1. Ticketvision, Inc. and its affiliates*
   Ticketvision, Inc. and its affiliates* is not associated with Ticketmaster, any theatre, venue, box office, artist, team or other ticketing company. Tickets purchased through Ticketvision, Inc. and its affiliates* usually cost more than the box office face value price. As an independent agency we charge a premium above the face value for our tickets. This premium will vary from event to event and from venue to venue. Our prices reflect the costs involved in obtaining quality seating for you, our customer. The additional fees vary per ticket based on many factors such as availability, desirability, difficulty in obtaining, and lead-time
   
2. Note that online orders placed after 5PM US Pacific Standard Time on weekdays or at any time on weekends may not be processed until the next working day.
   
   If Ticketvision, Inc. does not deliver to a purchaser the full quantity of tickets agreed to, Ticketvision, Inc.'s sole obligation or liability shall be limited to the return to purchaser any deposits and/or payments for undelivered tickets previously made by purchaser to Ticketvision, Inc. under our terms and conditions of any sale.
   
   Ticketvision, Inc and it's affiliates* reserve the right to upgrade your tickets at no additional cost to comparable or better seating or your money is refunded! With all ticket sales and pre-order sales, we guarantee to give youtickets you ordered or better, or your money back!
   
   
3. Return Policies
   ALL SALES ARE FINAL*. No cancellation, refunds, exchanges, or credits can be made after your order has been confirmed. Please note that revisions, changes or requests for cancellations of unconfirmed orders must be approved by a representative during business hours. A 10% cancellation fee of any unconfirmed order will apply. If there is a postponement or rescheduling, your tickets will be honored on the new date and you are responsible for the new arrangements. If an event is cancelled, we will refund all monies paid minus the processing/shipping costs upon return of the tickets to our office. Do not return tickets to the boxoffice. We must receive the tickets in our office before we can process a refund.
   
   We do not replace lost, damaged or stolen tickets. Do not expose your tickets to sunlight, heat, cold, or liquids. The tickets cannot be replaced under any circumstances and you will bear the full loss and liability incurred.
   
4. Event Cancellation Policy
   In the event that an artist, venue, promoter or artist's management company should cancel or postepone an event, Ticketvision will not be held legally responsible for any consequential or incidental damages including transportation, hotel or food expenses. Customers accept all customary risks associated with Live entertainment.
   
5. Payment Terms
   Terms of payment shall be determined at the discretion of Ticketvision, Inc. and its affiliates* . Ticketvision, Inc. and its affiliates* must receive payment prior to Ticketvision, Inc. and its affiliates* ’s acceptance of Customer's order. Payment shall be made by credit card, cashier’s check, money order or some other pre-arranged method of payment acceptable to Ticketvision, Inc. and its affiliates*
   
   Where payment is made by credit card, such payment is subject to the approval of the financial institution issuing the credit card. Ticketvision, Inc. and its affiliates* shall not be liable in any way if such financial institution refuses to accept or honor the credit card for any reason.
   
6. Shipping / Delivery
   Tickets are shipped via Federal Express when time permits. A signature will be required on all deliveries. We do not allow any re-routes on ticket deliveries. The courier must deliver it to the address on the package. Tickets are normally sent to your credit card billing address. The Billing Address will be verified with your credit card company so you must use the exact address that your statements are sent to. Should you require that the order be shipped to an address other than the credit card billing address we will require a faxed authorization from you. This includes a signed copy of the invoice along with legible copies of your driver's license and the credit card that was used. This is done to protect both of us against fraudulent use.
   
   When necessary tickets can be hand delivered to your hotel to the attention of the registered guest only. Upon confirmation of your order you will be notified of the estimated date of delivery of your tickets.
   
7. Risk of Loss
   The risk of loss and title for all items purchased from TicketVision, Inc. pass to you upon our delivery to the carrier. We do not replace lost, damaged or stolen tickets. Do not expose your tickets to sunlight, heat, cold, or liquids. The tickets cannot be replaced under any circumstances and you will bear the full loss and liability incurred.
   
8. Order Acceptance Policy
   Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Ticketvision, Inc. and its affiliates* reserves the right at any time after receipt of your order to accept, decline or refuse service for any reason. All orders placed over $1000.00 (U.S.) must obtain a signed pre-approval with an acceptable method of payment, as established by our accounting, credit and fraud department. We may require additional verifications or information before accepting any order.
   
9. Jurisdiction and Venue
   The rules and laws of the county of Orange and the State of California govern the use of or orders made on the Ticketvision, Inc. and its affiliates* site. You agree that any legal action brought against Ticketvision, Inc. and its affiliates* shall be governed by the laws of the county or Orange and the State of California without regard to its conflict of law principles. You agree that the sole jurisdiction and venue for any litigation arising from your use of or orders made on the Ticketvision, Inc. and its affiliates* sites shall be an appropriate federal or state court located in Orange County, California.
   
10. Typographical Errors
    In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, Ticketvision, Inc. and its affiliates* shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. Ticketvision, Inc. and its affiliates* shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Ticketvision, Inc. and its affiliates* shall issue a credit to your credit card account in the amount of the charge.

15. Sales Tax
    Ticketvision, Inc. and its affiliates* shall automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within Chicago, Illinois, Massachusetts, and Tennessee. Each customer shall be solely responsible for all sales taxes, or other taxes, on orders shipped to any other state.
    
16. Service and Support
    Ticketvision, Inc. and its affiliates* endeavors to provide the best customer and technical support. Ticketvision, Inc. and its affiliates* promises that its support people will attempt to handle over the telephone and email any problem involving Ticketvision, Inc. and its affiliates* products. All requests for service and support should be made directly to Ticketvision, Inc. and its affiliates*
    
17. Invalidity of Provisions
    If any provision or provisions of this Agreement shall be held to be invalid, illegal or unenforceable, such provision shall be enforced to the fullest extent permitted by applicable law, and the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.
    
18. Headings
    The headings of each of these terms and conditions are for convenience of reference only and shall not form part of these terms and conditions. Such headings shall be ignored in the interpretation or construction of any of these terms and conditions.
    
19. Exclusion and Limitation of Liability
    IN NO EVENT SHALL TICKETVISION, INC. AND its AFFILIATES BE LIABLE TO CUSTOMER OR ANY THIRD PARTY FOR ANY SPECIAL, INDIRECT, CONSEQUENTIAL OR PUNITIVE LOSS OR DAMAGE FOR ANY BREACH OF THESE TERMS AND CONDITIONS, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF BUSINESS OR GOODWILL, LOSS OF USE EVEN IF TICKETVISION, INC. AND its AFFILIATES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE OR ANY CLAIM BY ANY THIRD PARTY.
    
    TICKETVISION, INC. AND its AFFILIATES SHALL NOT BE LIABLE IF IT IS UNABLE TO PERFORM ANY OF ITS OBLIGATIONS CONTAINED IN THESE TERMS AND CONDITIONS DUE TO, DIRECTLY OR INDIRECTLY, THE FAILURE OF ANY MACHINE, SYSTEM OF AUTHORIZATION, DATA PROCESSING OR COMMUNICATION SYSTEM OR TRANSMISSION LINK OR ANY INDUSTRIAL DISPUTE, WAR, FLOOD, EXPLOSION, ACT OF GOD OR ANY OTHER EVENT BEYOND THE CONTROL OF TICKETVISION, INC. AND its AFFILIATES
